• collects, stores, or solicits information about other users or members for commercial or unlawful purposes, or engages in commercial activity such as contests, lotteries, etc. without the prior consent of SmailAds classifieds
• contains personally identifying information about another member and is posted without their express consent
• contains material originally posted by another member and is reposted without permission or attribution
• contains misleading email addresses or other manipulated identifiers to disguise its origin
• is knowingly posted in an irrelevant category or city, or repeatedly posts the same or similar content, or imposes an unreasonably or disproportionately large load on SmailAds classifieds infrastructure
• is from more than one member account
• circumvents or attempts to overcome any security or verification measures relating to the use of the Website and Application or Services

Additionally, you agree not to do the following:

• contact anyone who has requested not to be contacted
• "stalk" or otherwise harass anyone
• delete or revise any material posted by any other user
• impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
• use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Website or Application
• attempt to gain unauthorized access to SmailAds classifieds computer systems or networks, or engage in any activity that disrupts or diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service or the Website or Application

5. 5. No Spam Policy

You understand and agree that sending unsolicited email advertisements to SmailAds classifieds email addresses or through SmailAds classifieds computer systems, which is expressly prohibited by these Terms, will use or cause to be used servers located in California. Any unauthorized use of SmailAds classifieds computer systems is a violation of these Terms and certain federal and state laws, including, without limitation, the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.), Section 502 of the California Penal Code, and Section 17538.45 of the California Business and Professions Code. Such violations may subject the sender and their agents to civil and criminal penalties.

6. 6. Ownership

All right, title, and interest in and to the Website and Application and the Service are and will remain the exclusive property of SmailAds classifieds and its licensors. "at.smailads.com," and "Web Annonces SAP LLC," and SmailAds classifieds logos, icons, and other marks identifying SmailAds classifieds services or products are trademarks ofSmailAds classifieds and may not be used without prior written permission. In the event of a dispute, you hereby release SmailAds classifieds, its officers, employees, agents, and successors in rights from claims, damages, and demands of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and our Service.

If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

8. 8. Limitation and Termination of Service

10. 10. Disclaimer of Warranties

Neither SmailAds classifieds nor its licensors or suppliers makes any warranty that the website and application, service, or content will meet your requirements, or that the website and application or service will be uninterrupted, timely, secure, or error-free; nor do SmailAds classifieds or its licensors or suppliers make any warranty as to the results that may be obtained from the use of the service or as to the accuracy, truthfulness, or reliability of any information obtained through the service or that defects in the website or application will be corrected. 11. 11. Limitation of Liability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be deleted and the remaining provisions shall be enforced. SmailAds classifieds failure to act with respect to a breach by you does not waive SmailAds classifieds right to act with respect to subsequent or similar breaches. You may not assign or transfer these Terms or any rights hereunder, and any attempt otherwise is void. These Terms will inure to the benefit of and be binding upon each party's successors and assigns. The management of Web Annonces SAP LLC  Portal "SmailAds classifieds" shall not be liable for any delay or failure in performance resulting directly or indirectly from any causes beyond SmailAds classifieds reasonable control. Any notice required or given to you under these Terms shall be delivered via email to the email address provided by you during registration. These Terms constitute the entire and exclusive understanding and agreement between the parties with respect to the subject matter hereof and supersede all prior understandings, proposals, agreements, negotiations, and discussions between the parties, whether written or oral.

14. 14. Professional User *

• All fees are non-refundable, in whole or in part, even if the service is suspended or canceled before the end of your monthly or annual plan.

• Purchases of "Packages," Promotion of "Ads" of any kind, and "Banner" Advertisements

• All purchases are final, irrevocable, and non-refundable. Once a product of SmailAds classifieds Portal (Application and Website) "SmailAds classifieds" is purchased (even if not activated) or once any amount is paid to us in advance, you will not be allowed to request, claim, or otherwise seek:
   
  - A refund
   
  - Replacement of the product with cash or any other product
   
  - Purchase of a product or service not provided by us or by anyone else or any other platform, or the assignment of any SmailAds classifieds Portal (Application and Website) products (or their value) to anyone else (unless approved by us).

  We reserve the right, at any time, to

  - Add taxes to any of SmailAds classifieds Portal (Application and Website)'s products, in accordance with applicable laws.
  - Stop or suspend any payment method, anywhere in the world, or in a specific country, or regarding a specific section.
  - Impose or modify fees related to the use of any payment method.
  - Impose a currency conversion fee related to payments made in currencies other than those we accept.
• - If any account becomes inactive, suspended, or canceled, your right to use any amounts paid to us lapses.
  - Change the terms and conditions associated with any payment method and/or
  Change the way a user may pre-pay for any SmailAds classifieds Portal (Application and Website) products.
  We will not bear any responsibility whatsoever for the exercise of these rights.
• - If you have pre-paid for an SmailAds classifieds Portal (Application and Website) product, you must activate this product within a specified period, and if you fail to do so, we have the right to set or determine the activation period (which may be modified at our sole discretion from time to time). If you do not activate any SmailAds classifieds Portal (Application and Website) product during the activation period (which we inform you of through any of our available communication methods), you will not be able to activate it later, and you will not have the right to receive any compensation or refund from us.
• - We reserve the right to reject any payment received or confiscate any amounts we believe were directly or indirectly paid or obtained through fraudulent or illegal means without the need to send a notice, and we will not bear any responsibility whatsoever for the exercise of these rights.
• - In the event that the user fails to pay any amounts due on their due dates, or in the event that any checks are returned due to insufficient funds or for any other reason, SmailAds classifieds Portal (Application and Website) has the right to immediately suspend the account and service until full payment or a settlement is made between us, without the need to send a written notice to the user or to send any judicial warning or initiate any judicial or arbitration proceedings.
